What to do after an accident in Pennsylvania or New Jersey

The NJ and PA injury attorneys at Saile & Saile LLP, often get telephone calls weeks and sometimes months after a Bucks County truck accident, a Mercer County motorcycle accident, or auto accident. For many reasons, injured people often delay speaking to an injury lawyer and getting their injury claim started. For those injured persons who have not yet contacted a NJ or PA injury attorney, here are a few tips so that you do not make any major mistakes that could hurt or kill your Pennsylvania or New Jersey injury claim:
  1. First and foremost, do NOT talk to the other driver or his or her insurance company. Much like a criminal case, anything you say may be used against you in your claim. This is called a party admission. If you do answer the phone, politely tell the caller that you have consulted with a lawyer and that your lawyer will be contacting he or she shortly.
  2. Follow up with your family doctor at your first opportunity. Set up an appointment no more than one or two days after accident. If your family doctor is not comfortable treating accident patients, ask to be referred to another injury doctor.
  3. Preserve all physical evidence. Take pictures of your car or motorcycle and, if possible, the other car, or truck. Take pictures of the intersection where the accident took place. Take pictures of any skid marks and any debris on the roadway at the time of the accident. If your injuries are visible, take pictures of your injuries daily. Safeguard these photos both physically and electronically.
  4. Obtain a copy of the police accident report. The police officer who responded to the scene will prepare an accident report. It usually takes the police department a few weeks to complete the report.
  5. Keep a daily journal. Document all telephone calls that you make and receive regarding your case. Document your pain, medications, and medical treatment. Keep a list of the names and addresses of all of your medical providers.
  6. Consult with an experienced NJ or PA injury lawyer. A local lawyer will provide you with the best insight as to local insurance company adjusters and juries. Most, if not all, injury lawyers offer a free consultation.
