Children at Risk for Pedestrian Accident Injury

You, like most people, probably think of a Philadelphia area pedestrian accident as one that happens when a person is hit attempting to cross a busy stretch of roadway; one where drivers of cars and trucks traveling too quickly, or while under the influence (DUI) cannot stop in time or do not see them at all. While that is often the case, many times, the pedestrian is a child. All too often, the child is run over on their own street or even in their own driveway.

In February of 2008, President Bush signed a bill into law known as the Cameron Gulbransen Safety Act of 2007 to help reduce child pedestrian accidents and the injuries associated with them. The Act requires car manufacturers to install brake shift interlocks as well as other features to improve safety on all new vehicles. A brake shift interlock requires that you step on the brake in order to put the car in gear. This requirement was an effort to reduce the possibility that your child or the child of a loved one might put your car in gear while he or she has the opportunity.

While the Bucks County personal injury lawyers at Saile & Saile LLP applaud the law, there is still a period of implementation that could take up to eight years. Some manufacturers have added cameras in the rear of the vehicle so that the driver can see behind it from the console.

In the tragic case of Cameron Gulbransen, for which the new law was named, it was his father who backed over the two year old, fatally injuring him in the family's driveway. He was unable to see his son in the blind spot of his SUV. This sort of accident, categorized as a child pedestrian accident could happen to any child, and it is often a friend or relative who is at the wheel.

What if your car is not equipped with rear viewing camera?
  • Install an after-market camera for the rear of your vehicle.
  • Always walk behind your vehicle before entering it to check for people you could injure or objects you could hit before backing out of a parking space or driveway
