Philadelphia Auto Accident Attorneys’ Fee Agreements for Pennsylvania & New Jersey Personal Injury Clients

Traditionally, attorneys have billed clients by the hour for time spent on the client's particular file. In response to this problem, many attorneys have obtained approval from the Supreme Court to offer contingent fee agreements. Simply put, a contingent fee agreement means that the law firm will not charge the injured person for legal services unless that person's case yields a financial recovery.

In the state of New Jersey, contingent fee agreements for attorneys are set by law. In a typical New Jersey or Mercer County personal injury case (specifically, any case that results in compensation of $500,000 or less), the contingent fee is 1/3 of the total recovery amount, after expenses from the case are paid.

The law in Pennsylvania is different: unlike New Jersey requirements, the state of Pennsylvania does not set or limit the percentage of recovery lawyers may charge. The result? Not only do many Pennsylvania and Bucks County personal injury lawyers charge as much as 40 to 50% of the recovery on a routine basis, but they also calculate that percentage before case expenses are paid.
