What are the exceptions to the Pennsylvania Limited Tort Law?

A: So you made the mistake and chose limited tort on your Pennsylvania auto insurance policy. Perhaps you didn't know the benefits of full tort or perhaps you couldn't afford full tort, but now are you stuck with your choice of limited tort auto insurance for this auto accident?

Your personal injury claim may qualify for one of the exceptions to Pennsylvania's limited tort law. Whenever the other driver is a fault and he or she:

- Is convicted of DUI or accepts ARD, which is otherwise known as Pennsylvania's drunk driving First Offender's Program,

- Is operating a vehicle registered in a state other than Pennsylvania,

- Has not maintained auto insurance,

- Intended to injure himself or herself, or

- Was in the business of fixing cars and did not fix the car properly which caused the PA auto accident.

These Pennsylvania limited tort exceptions do not apply to uninsured motorist coverage or underinsured motorist coverage.
