I am a Pennsylvania driver and I was injured in a New Jersey car accident...am I full or tort or limited tort?

This is a very complicated question because there are several exceptions that will make a limited tort case a full tort case.  New Jersey does not use the terms "limited tort" or "full tort".  NJ uses the words "verbal threshold" and "zero threshold" when describing auto insurance. Both PA and NJ have different auto accident laws regarding the meaning of these restrictions on the right to sue for pain and suffering.

The NJ Deemer Statute states that every out-of-state driver (including PA drivers) that is injured in an NJ auto accident are deemed verbal threshold (restriction on lawsuit), unless the out-of-state driver's insurance company does NOT do business in New Jersey.
