Does the Pennsylvania Limited Tort Law apply to Pedestrians?

A: Limited Tort auto insurance in Pennsylvania restricts an insured's right to sue and recover compensation for pain and suffering after a PA car accident. You chose either limited tort or full tort when you purchase Pennsylvania auto insurance. Resident household family members may also bind other household family members on their "tort" election.

The good new is, pedestrians in Pennsylvania are not bound by the limited tort restriction in Pennsylvania pedestrian accidents. The Pennsylvania Supreme Court ruled that the limited tort restriction only applies to drivers of automobiles and occupants, not innocent pedestrians. Even if you or a family member chose limited tort on your PA auto insurance policy, if you are injured while a pedestrian, you are not bound by limited tort...YOUR ARE FULL TORT!

Pennsylvania's limited tort law was originally designed by the PA legislature to reduce the costs of Pennsylvania's mandatory auto insurance. Many PA injury lawyers would argue that the limited tort law has no effect on the overall cost of Pennsylvania auto insurance. The Pennsylvania Supreme Court has also stated that the cost of PA auto insurance would not be affected if pedestrians were subject to Pennsylvania's limited tort law.

Pedestrian accidents occur all year long in Pennsylvania. Lighting conditions (day vs. nighttime) and weather conditions (clear vs. rain) seriously affect the amount of pedestrian accidents. Our Bucks County based injury law firm represents victims of pedestrian accidents throughout the States of New Jersey and Pennsylvania.
