Am I at fault if I did not cross the road in a crosswalk?

A: The fact that you did not cross the road at a crosswalk does not automatically make a pedestrian at fault for a pedestrian - auto accident. The driver of a motor vehicle, such as a truck or car, has a duty to control his or her vehicle and maintain a safe speed at all times so that he or she can stop the vehicle in enough time to prevent a pedestrian accident. If a pedestrian runs into the street and the driver of the vehicle does not have the time to stop, the pedestrian may be at fault for the pedestrian accident. In a civil case in Philadelphia or Bucks County, the injured pedestrian, otherwise known as the plaintiff, must be able to prove "more likely than not" that the pedestrian accident was the driver's fault. An experienced pedestrian accident lawyer can help you evaluate your PA or NJ pedestrian injury case.
